Net fee means the commission is calculated on the amount excluding VAT.
If we broker a collaboration for you with a net fee of €1,000, FNLY Agency receives €200 of it and €800 goes to you. Commission only applies if we brokered or managed the deal. If a brand contacts you directly and you handle the job yourself, the entire fee is yours.
According to the Medialawblog of the law firm Brost Claßen, management commissions in the market are usually between 15 and 25% of net income. At 20% we sit in the middle of this range, with the difference that we state the figure openly before the contract is signed.
These clauses come up again and again in other providers' management contracts. At FNLY Agency they are ruled out.
Commission on all income rather than only on brokered deals means you pay for jobs the agency was not involved in. Add a long term with automatic renewal and post-termination commission, and you can hardly get out of a bad contract, while switching costs you part of your income for years. If you assign the rights to your content wholesale to the agency, it may be able to keep using your videos and images without you.
There are also limits to how high commission can be. According to media lawyers, the Brandenburg Higher Regional Court (OLG Brandenburg, Az. 4 U 151/13) did not consider a commission of 30% to be contrary to public policy (sittenwidrig), although it is at the upper end. The Potsdam Regional Court (LG Potsdam, Az. 2 O 101/20) assessed 40%, together with other circumstances disadvantageous to the artist, as essentially akin to usury. Whether a specific contract is valid always depends on the individual case.

During a campaign for a brand, you do not promote a direct competitor at the same time. When the campaign ends, this commitment ends too.
As soon as the client has paid, you receive your share within 14 days. We take care of billing the client and chasing outstanding invoices.
You can apply from the age of 16 if your parents agree. Under §§ 107 and 108 of the German Civil Code (Bürgerliches Gesetzbuch, BGB), minors can only validly enter into contracts that place obligations on them with the consent of their legal guardians. That is why we involve your parents from the start, and they co-sign the contract. This also applies to every individual collaboration we conclude for you.
